You can't kill non-hostile ships AFAIK. If you do that a screen appears and tells you that you attacked a neutral ship and you can either reload or quit. I found out the hard way because of a bug in the game the three rheinlanders that approach you before you reach Sinclair didn't turn hostile, they just kept white-neutral. But the game expected them to turn hostile and as long as they weren't killed I couldn't dock at the planet or use any trade lanes. So I attacked the still white rheinlanders and as soon as I broke through their shields and did some serious damage... there was the exit screen. That was a serious bug but somewhat around the tenth try it suddenly worked und the three ships turned hostile. Well, that was their last mistake.
Anyway... when I completed Freelancer the first time, I got only one confimred battleship kill, in the second run I got two. I guess the lucky bloke who places the final shot gets the kill.
